FTC to Investigate Allegations of Blocking Renewable Fuel Access
The Federal Trade Commission (FTC) will investigate possibly alleged anti-
competitive practices by oil companies that may block market access for
renewable fuels, the agency announced last week.
Earlier this month, Sens. Amy Klobuchar (D-Minn.) and Chuck Grassley (R-Iowa)
sent a letter to the FTC and the Justice Department, asking them to investigate
"allegations that the oil industry is mandating retailers to carry and sell
premium gasoline, thereby blocking the use of the current retail infrastructure
to sell renewable fuels."
"I can assure you that we will evaluate the information you have provided and
the concerns you have expressed under pertinent antitrust standards," FTC
Chairwoman Edith Ramirez wrote in an Aug. 19 response to Grassley. "Protecting
American consumers from anticompetitive or fraudulent practices in the energy
sector has long been one of our most important responsibilities, and I can
assure you that we will continue to make every effort to identify, prevent and
prosecute practices in petroleum and other markets that violate any statute or
rule that the agency enforces," she added.
The senators' letter follows a March request by the Renewable Fuels Association
(RFA) to EPA, FTC, DOE and USDA, urging an investigation into "highly
discriminatory and unlawful conduct" against the first marketer in the country
to offer E15, a Zarco 66 fuel station in Lawrence, Kan. Shortly after the
station began offering E15, ConocoPhillips threatened to terminate Zarco 66's
franchise agreement and charge it penalties unless the station started offering
premium gasoline that would replace the ethanol housed in one of Zarco's fueling
tanks, RFA explained in March.
